These Terms and Policies govern your use of our website and the services we provide. By accessing or using our services, you agree to be bound by these terms. This document constitutes a legally binding agreement between you and HiJourne.com (referred to as “we”, “us”, or “our”).
1. General Terms
1.1. Acceptance of Terms By booking a tour or using any service offered by HiJourne.com, you acknowledge that you have read, understood, and agreed to these Terms and Policies.
1.2. Service Description Journesrilanka.com acts as tour operator for a wide range of community based tourism experiences in Northern Sri Lanka, including pre-packaged tours, custom itineraries, transportation, and accommodation. We work with a network of trusted local community service providers, including hotels, licensed guides, and transportation providers.
2. Bookings and Payments
2.1. Booking Confirmation All bookings are considered confirmed only upon our receipt of a non-refundable deposit, as specified in your booking confirmation. The booking is not confirmed until we have issued a Confirmation Voucher to you.
2.2. Payment Schedule A non-refundable deposit, typically 40% of the total tour cost, is required to secure your booking. The remaining balance must be paid no later than one day prior to the commencement of your tour.
For bookings made within 03 days of the tour start date, full payment is required at the time of booking.
2.3. Payment Methods We accept payments via bank transfer and a range of credit/debit cards, and also cash in hand payments. All bank charges and currency conversion fees related to international transfers are the sole responsibility of the client.
2.4. Pricing and Currency All prices are quoted in United States Dollars (USD) unless otherwise stated. Prices are subject to change without notice until a booking has been confirmed with a deposit. Deposits may be made in Sri Lankan Currency.
3. Cancellations and Refunds
3.1. Cancellation by Client All cancellation requests must be made in writing via email. The cancellation is effective from the date we receive the written notification.
The following cancellation fees will apply:
- 15 days or more before tour start: Loss of non-refundable deposit
- 10 days before the tour starts: 50% of the total tour cost
- 05 days before the tour starts: 75% of the total tour cost
- Less than 03 days before tour start: 100% of the total tour cost
- No-show: 100% of the total tour cost
3.2. Cancellation by HiJourne.com We reserve the right to cancel any tour due to unforeseen circumstances beyond our control (e.g., Force Majeure events). In such cases, you will be offered a full refund of all payments made, or an alternative tour of a similar standard. We will not be liable for any additional costs incurred by you, such as flights or visa fees.
3.3. Refund Processing Refunds will be processed within 15 business days of the cancellation being confirmed.
4. Client Responsibilities
4.1. Documentation You are solely responsible for ensuring you possess a valid passport, the necessary visas, and any other travel documents required for your trip to Sri Lanka. Your passport must be valid for at least six (6) months from the date of your arrival.
4.2. Health and Fitness You must ensure that you are medically and physically fit for the tour and any included activities. We reserve the right to refuse participation in certain activities if we have safety concerns.
4.3. Travel Insurance We strongly recommend that you purchase comprehensive travel insurance that covers cancellation, medical expenses, baggage loss, and personal liability. We are not liable for any losses incurred due to a lack of, or insufficient, travel insurance coverage.
4.4. Compliance with Local Laws You are required to comply with all local laws, customs, and regulations during your tour in Sri Lanka. We reserve the right to terminate your tour if your conduct is deemed offensive, illegal, or a nuisance to other participants or the public.
5. Limitation of Liability
5.1. Agency Role HiJourne.com acts as a booking agent for third-party suppliers. We are not liable for any illness, injury, death, loss, damage, or delay resulting directly or indirectly from the acts or omissions of such suppliers, including but not limited to hotels, transportation companies, or guides.
5.2. Force Majeure We are not liable for any loss, damage, or delay caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, political instability, riots, strikes, or epidemics.
6. Privacy Policy
6.1. Data Collection We collect personal information, such as your name, contact details, passport information, and payment details, solely for the purpose of processing your booking and providing our services.
6.2. Data Usage Your data will be used to confirm your booking with third-party suppliers (e.g., hotels and guides), facilitate payment, and communicate with you about your tour. We will not sell, rent, or share your personal information with any unauthorized third parties.
6.3. Data Security We implement reasonable security measures to protect your personal information from unauthorized access and disclosure.
7. Intellectual Property
All content on the HiJourne.com website, including text, graphics, logos, images, and tour itineraries, is our exclusive property and is protected by copyright and intellectual property laws. You may not use this content without our prior written consent.
8. Governing Law and Jurisdiction
This agreement is governed by the laws of Sri Lanka. Any disputes arising from these Terms and Policies shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
